Want to break your lease earlier?
Whether as a result of financial hardship or other reasons, you are entitled to break the lease earlier than the expiry of the initial term, but you will be liable for the costs and loss caused to the landlord as a result of ‘breaking the lease contract’.
When sending your written notice to the landlord or property manager, it should also contain the date you will be leaving and ideally a request for help by the property manager and landlord to assist in finding a new tenant.
It is your responsibility to pay the rent due for the balance of the term.
The landlord can claim compensation for all associated costs of terminating the lease early and for loss, including losses and costs for:
the balance of rent payable until the next tenant occupies the premises or until expiry of the initial lease term;
advertising relative to the new rental, and
any reletting fees payable by the landlord to the agent in finding the new tenant.
